Distribution of a Controlled Substance

It is unlawful for any person knowingly to dispense, or distribute, or to possess with intent to dispense, or distribute, a controlled substance; or possess one or more chemicals or supplies with intent to manufacture a controlled substance.

Distribution of a controlled substance is typically a felony level offense based on the quantity of the drug alleged to have been distributed. If your child is prescribed medication and he or she shares that medication with a peer, they may be charged with felony distribution of a controlled substance. It is no defense that the medication they are sharing was lawfully prescribed to them. If the prescribed drug is classified as a controlled substance and it is given to someone else, your child may have committed an offense.
